Boat Party Waiver and Terms & Conditions Agreement

Operated by Batmania Tours Pty Ltd

By booking and attending this event, you acknowledge and agree to the following terms:

1. Property Damage

Any damage to the vessel or other property caused by you (whether accidental or intentional) is your sole responsibility. Batmania Tours Pty Ltd and its affiliates are not liable for any such damages, and you agree to reimburse the company for any repair or replacement costs incurred.

2. Assumption of Risk & Personal Responsibility

You understand that participation in a boat party involves inherent risks, including but not limited to movement of the vessel, consumption of alcohol, and interactions with others. You agree to attend at your own risk.

To the fullest extent permitted by law, Batmania Tours Pty Ltd, its employees, contractors, and affiliates shall not be held liable for any claims, damages, injuries, losses, or expenses (including indirect or consequential damages) resulting from your participation in the event — whether due to your own actions, negligence, or failure to exercise due care.

This includes, but is not limited to:

Tripping, slipping or falling on board or while embarking/disembarking

Jumping or falling overboard

Failing to follow safety instructions

Any other incident that could have been avoided with reasonable caution

You acknowledge full responsibility for your own safety and behavior throughout the event.
